Booking Terms & Conditions

Clear terms for booking, paying for and receiving photography services from Zoom Photo Studio.

These Booking Terms & Conditions apply to photography sessions, consultations, products, digital images and related services supplied by Zoom Photo Studio, operated by Justyna Ciemierz from Room 8, 48 Loons Road, Dundee, DD3 6AP (“Zoom Photo Studio”, “we”, “us” or “our”).

Please read these terms before booking. By paying a booking fee or other payment, confirming a booking in writing, or asking us to begin work, you confirm that you have read and accepted them. These terms should be read with our Cancellation Policy, Privacy Statement and Image Disclaimer.

1. Your booking

A booking request is not confirmed until we have accepted it and any booking fee or deposit shown at checkout or in our written quotation has been paid. Once confirmed, we will reserve the agreed date and time for you and send confirmation by email.

Please check the confirmation carefully and tell us promptly if any detail is incorrect. You are responsible for providing a working email address and telephone number and for checking your inbox and spam folder for messages about your booking.

The person making the booking must be at least 18 years old and must have authority to agree these terms on behalf of every participant for whom they are responsible. A parent or legal guardian must approve and supervise the participation of anyone under 18.

2. Prices and payment

The price, package contents, booking fee, balance and payment dates are those shown on the relevant booking page, quotation, invoice or booking confirmation. Unless we clearly state otherwise, a booking fee forms part of the total price.

Any remaining balance must be paid by the date stated in the booking confirmation or invoice. If payment is not received when due, we may suspend work or release the session date after giving you a reasonable opportunity to pay.

Optional extras, additional images, prints, albums, delivery charges and special editing are charged only where you request or approve them. Additional images selected through a client gallery must be paid for before the high-resolution files are released.

Online card and PayPal payments are processed securely by PayPal. We do not receive or store your complete card number or security code.

3. Consultations and preparation

You agree to provide accurate information about the session, the participants and any requirements that may affect our preparation or safe delivery of the service. This includes relevant accessibility needs, allergies, mobility concerns, medical advice or restrictions, and anything that may affect a maternity, newborn or children’s session.

Our preparation guidance, including advice about arrival time, clothing, styling and what to bring, forms part of the practical arrangements for the session. Please contact us before the session if you are unsure whether an activity, pose, prop or outfit is suitable.

4. Attendance, lateness and conduct

Please arrive at the agreed time. If you arrive late, we may need to shorten the session so that later clients are not affected. If the delay is so substantial that the session cannot reasonably proceed, it may be treated as a late cancellation under our Cancellation Policy.

You remain responsible for the behaviour and supervision of children, guests and animals attending with you. We may stop or adapt a session where continuing would be unsafe, unlawful, abusive, damaging to property, or seriously disruptive. We will always try to resolve concerns calmly and proportionately.

Smoking, vaping, illegal substances and threatening or abusive behaviour are not permitted in the studio. You are responsible for the reasonable cost of repairing deliberate or negligent damage caused by you or someone attending under your supervision.

5. Health, safety and comfort

Your comfort and safety matter. You may decline or stop any pose or activity at any time. We will use reasonable care and skill and will adapt the session where reasonably possible, but you must follow safety instructions and tell us immediately if you or a participant feels unwell or uncomfortable.

For newborn and child photography, a parent or legal guardian must remain present and responsible throughout the session. We will not require a child to perform a pose or activity that we consider unsafe or unsuitable.

6. Our photographic style and creative decisions

You are booking us because you are familiar with our portfolio and photographic style. We welcome reasonable preferences discussed before the session, but no two sessions are identical and we cannot promise an exact recreation of another image.

We retain professional and artistic discretion over lighting, posing, composition, image selection, colour treatment and retouching. We will exercise that discretion with reasonable care and skill and consistently with the service and style agreed with you.

Unless agreed in writing, unedited files, RAW files, test shots, duplicates and images that do not meet our professional standard are not supplied.

7. Image selection, galleries and delivery

Where an online gallery is provided, it is private to the client account and must not be shared with anyone who is not authorised to view the photographs. You are responsible for keeping login details and gallery links secure and for telling us promptly if you believe they have been disclosed.

Watermarked previews are supplied only for viewing and selection. They must not be copied, downloaded by technical workarounds, published, edited or used as final photographs.

The package includes only the number and type of images or products stated in the booking confirmation. Any further images are optional and charged at the price displayed before purchase.

Unless your confirmation states otherwise, download access is normally available for 30 days from the date shown in the gallery, and each purchased or included image may be downloaded a maximum of three times. You must download, check and securely back up your files before access expires. Gallery access and studio storage are not a permanent archiving service.

Please report missing, corrupt or incorrect files promptly after delivery so that we can investigate. Delivery times are estimates unless we expressly agree a fixed deadline in writing.

8. Prints and other physical products

Prints, albums, wall art and other made-to-order products are produced to the specification approved by you. Screen brightness and colour settings vary, so an on-screen image may not exactly match a professionally printed product.

Please inspect physical products promptly after delivery and tell us if anything is damaged, faulty or not as agreed. Your statutory rights in relation to faulty, misdescribed or unsuitable goods are not affected.

9. Copyright and your licence

Unless we agree otherwise in a signed written document, copyright in photographs created by Zoom Photo Studio remains with Zoom Photo Studio or the photographer. Payment for images does not transfer copyright.

Once you have paid for and received final digital images, we grant you a perpetual, non-exclusive licence to download, store, print and share them for your personal and domestic use. You may share them on personal social-media accounts, provided they are not sold, presented as somebody else’s work or used to promote a business without our written permission.

Commercial use, resale, publication by another business, competition entry by a third party, removal of a visible copyright notice, or licensing to others requires our prior written agreement. Please contact us if you need a commercial licence.

10. Use of your images by Zoom Photo Studio

Booking a session does not by itself give us permission to publish private commissioned photographs. Portfolio, website, social-media, advertising, competition or printed-sample use will be dealt with separately and requires the appropriate written permission. You may refuse marketing use without affecting the service you receive.

For identifiable children, permission must be provided by a person with parental responsibility. Further details, including how to change a permission choice, are in our Image Disclaimer and Privacy Statement.

11. Changes, cancellation and rescheduling

If you need to cancel or move a booking, please contact us as soon as possible. The notice periods, treatment of booking fees and approach to illness, emergencies and non-attendance are set out in our Cancellation Policy, which forms part of these terms.

If we need to make a significant change, we will explain it and offer a reasonable alternative. If we cannot provide the agreed service, you may choose an alternative date or a refund of sums paid for the part of the service we cannot provide.

12. Events outside reasonable control

Neither party will be responsible for a delay or failure caused by circumstances that could not reasonably have been prevented, such as serious illness, bereavement, dangerous weather, travel disruption, utility failure, government restriction or venue closure. We will communicate promptly and first try to rearrange the affected service. Any cancellation charge or refund will reflect the services already supplied, costs that cannot reasonably be recovered and each party’s legal rights.

13. Problems and liability

We will provide our services with reasonable care and skill. If you believe there is a problem, please give us a reasonable opportunity to investigate and, where appropriate, repeat or correct the affected part of the service.

We are responsible for losses that are a foreseeable result of our breach of contract or failure to use reasonable care and skill. We are not responsible for losses that were not reasonably foreseeable, for business losses arising from a consumer booking, or for failure caused by inaccurate information, unsafe conduct or instructions contrary to our advice.

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.

14. Complaints

Please raise any concern with Justyna as soon as possible by emailing hello@zoomphotostudio.co.uk. Tell us your booking reference, what happened and the outcome you are seeking. We will acknowledge the complaint and aim to provide a substantive response within 14 days.

15. General terms

If a court finds part of these terms invalid or unenforceable, the remaining terms will continue to apply. A delay in enforcing a right does not waive that right. Nobody other than you and Zoom Photo Studio has a right to enforce this agreement unless the law says otherwise.

These terms are governed by Scots law. The Scottish courts will have jurisdiction, although a consumer living elsewhere in the United Kingdom retains any mandatory right to bring a claim in the courts available to them.

Nothing in these terms restricts rights given to you by the Consumer Rights Act 2015 or other applicable consumer law.
