These Website Terms & Conditions govern use of www.zoomphotostudio.co.uk (“the website”). The website is operated by Zoom Photo Studio, owned by Justyna Ciemierz and based at Room 8, 48 Loons Road, Dundee, DD3 6AP.
By using the website, you agree to these terms. If you do not agree, please stop using it.
1. Other terms that apply
These website terms should be read with our Privacy Statement, Cookie Policy and Image Disclaimer.
If you book or purchase photography services, our Booking Terms & Conditions and Cancellation Policy also apply. If there is a conflict about a booking, the specifically agreed booking terms take priority.
2. Website information
We aim to keep the website accurate and up to date, but photography packages, availability, prices, locations, timings and examples may change. General website content is provided for information and does not become a binding offer until a booking or order is accepted by us.
Please contact us if you need information to be confirmed before making an important decision or incurring travel or other costs.
3. Availability and changes
We may update, suspend or withdraw any part of the website for maintenance, security, legal or business reasons. We do not guarantee that the website or every feature will always be available, uninterrupted or free from error.
We will take reasonable care when operating booking, payment and client-gallery functions and will correct material faults brought to our attention.
4. Accounts and private galleries
Client accounts, password-reset links, gallery links and access keys are confidential. You must not share them with an unauthorised person or allow another person to use your account. Please tell us immediately if you believe access details have been lost, disclosed or misused.
You must not attempt to access another client’s account, gallery, image or personal information, defeat a download limit, remove a watermark, alter a payment record or bypass any technical restriction.
We may temporarily restrict access where reasonably necessary to protect clients, photographs, payments or the website. This does not affect your right to receive products and services already purchased.
5. Acceptable use
You must not use the website:
- for an unlawful, fraudulent, abusive or misleading purpose;
- to introduce malware, harmful code or automated traffic that interferes with the service;
- to probe, scan, scrape or test security without written permission;
- to obtain images, data or content through a route not intentionally provided to you;
- to impersonate another person or submit false booking or payment information;
- to infringe privacy, copyright, trade marks or any other person’s rights; or
- to reproduce a substantial part of the website, database or client area.
We may block abusive traffic, preserve relevant evidence and report suspected criminal activity where reasonably necessary.
6. Intellectual property
The website design, written content, branding, graphics, software and photographs are owned by or licensed to Zoom Photo Studio and are protected by copyright, trade-mark and other intellectual-property laws.
You may view pages and print a reasonable copy for personal reference. You must not copy, republish, sell, alter, remove notices from, frame, scrape, distribute or commercially exploit website content without written permission.
Rights in commissioned client photographs and the personal-use licence supplied with purchased images are explained in our Booking Terms & Conditions and Image Disclaimer.
7. Information you submit
You must ensure that information supplied through a form, account or booking is accurate and that you are entitled to provide it. Do not submit unlawful material, malicious code or information about another person without appropriate authority.
We use submitted personal information only as explained in our Privacy Statement. Supplying information does not give us ownership of your personal data.
8. Links and third-party services
The website may link to or use services operated by third parties, including PayPal, Google Maps and social-media platforms. Links are provided for convenience and do not mean that we control or endorse all content on the external service.
Third-party services have their own terms and privacy arrangements. We are not responsible for an external website that we do not operate, although we remain responsible for choosing and using our own service providers in accordance with applicable law.
9. Linking to this website
You may link fairly and lawfully to a public page, provided the link does not damage our reputation, imply an association or endorsement that does not exist, or display our content in a misleading frame. You must not link directly to a private client page, gallery file or restricted resource.
We may ask for a link to be removed where it is misleading, unlawful or compromises privacy or security.
10. Viruses and security
We take reasonable measures to maintain website security, but cannot guarantee that internet communications or downloaded material will always be free from harmful components. You should use appropriate device security, maintain backups and keep your browser and operating system up to date.
11. Responsibility for loss
We are responsible for loss or damage that is a foreseeable result of our breach of these terms or our failure to use reasonable care and skill. We are not responsible for loss that was not reasonably foreseeable or for business loss arising from a consumer’s use of the public website.
We are not responsible for disruption or loss caused by your device, internet connection, unauthorised sharing of credentials, unlawful use of the website, or a third-party service outside our reasonable control.
Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or liability under statutory consumer rights.

13. Changes to these terms
We may revise these terms to reflect changes to the website, our services or the law. The new version applies from the date published and does not retrospectively alter a confirmed booking unless the parties agree or the law requires it.
14. General provisions
If any part of these terms is found invalid or unenforceable, the remaining terms continue to apply. A delay in exercising a right does not waive it. These terms do not create rights for a person who is not a party to them, except where the law provides otherwise.
15. Law and jurisdiction
These terms are governed by Scots law. The Scottish courts will have jurisdiction, although a consumer living elsewhere in the United Kingdom retains any mandatory right to use the courts available to them.
